These Terms of Trade apply to work supplied by Concrete Grindpro NZ Limited trading as Concrete Grind Pro ("Concrete Grind Pro", "we", "us" or "our"). Please attach this document to the accepted Xero quotation. Together with the accepted quotation and any agreed written variations, these Terms form the agreement for the work.

The accepted Xero quotation, these Terms of Trade and any agreed written variations form the agreement for the work.
Acceptance of the quotation confirms the customer's agreement to the quoted scope, pricing and these Terms of Trade.
Our quotation is based on the scope, measurements, quantities and information available when the quotation is prepared.
Work outside the quoted scope is not included unless specifically stated in the quotation.
Quoted quantities, including square metre quantities, are an important part of our pricing. Where the customer materially reduces the quoted area or scope, Concrete Grind Pro may review and adjust the quoted pricing.
Quotations are valid for 30 days unless otherwise stated.
Unless otherwise stated in the quotation, a 50% deposit is required to secure the agreed commencement date.
The remaining balance is payable within 7 calendar days of the final invoice, unless another arrangement has been agreed in writing.
For larger commercial projects, staged payments may be agreed in writing before work commences.
Any genuine invoice query should be raised promptly. Undisputed amounts remain payable by the due date.
Concrete Grind Pro works with the existing concrete slab. The condition of the existing concrete can have a significant effect on the final appearance and performance of the finished floor.
Existing conditions may include:
Grinding can reveal conditions that were not visible before the surface was opened.
Existing cracks, joints, repairs, stains, aggregate variation and other characteristics may remain visible after grinding, polishing or treatment.
Unless specifically agreed in writing, Concrete Grind Pro does not guarantee a completely uniform colour, aggregate distribution, appearance or texture across an existing slab.
Additional preparation may be required depending on the condition of the concrete or site.
This may include crack repairs, joint filling, pinhole filling, patching, adhesive or coating removal, GM3000 or other preparation or treatment.
Where reasonably practicable, additional work will be discussed with the customer before it is undertaken.
Work requested by the customer, required because of site conditions, or outside the quoted scope may result in an additional charge.
Variations may be agreed in writing by quotation, email, Xero, text message or other documented communication.
The customer or principal contractor is responsible for providing safe and reasonably clear access to the work area.
The work area must be ready for the agreed works unless preparation has been specifically included in the quotation.
Suitable power and water must be available where required.
Commercial projects may require suitable three-phase power.
Where suitable power or water is unavailable, Concrete Grind Pro may arrange alternative supply, including generator hire, by agreement. Applicable costs will be charged to the customer.
The customer is responsible for arranging the isolation or management of fire alarms and other building alarm systems where required.
The customer must advise Concrete Grind Pro of known hazards, restricted access or other site conditions that may affect the work.
Concrete grinding and preparation can produce dust, slurry and waste.
Concrete Grind Pro will use appropriate dust-control and containment methods reasonably practicable for the agreed work.
Unless specifically included in the quotation, skip bins, waste removal, disposal fees and other waste-management costs are additional.
Where agreed, Concrete Grind Pro may arrange waste removal, skip bins or disposal on the customer's behalf and charge the applicable cost.
The agreed commencement date is subject to the site being ready and accessible.
Delays caused by the customer, principal contractor, other trades, restricted access, unavailable power or water, incomplete preceding works or other circumstances outside our reasonable control may affect the programme.
Where a delay results in additional reasonable labour, equipment, travel, accommodation or hire costs, those costs may be charged where applicable and permitted by law.
If agreed works are cancelled or postponed after a commencement date has been secured, Concrete Grind Pro may recover reasonable costs already incurred or committed in relation to the project, subject to applicable law.
Where an undisputed amount remains overdue, Concrete Grind Pro may suspend or postpone further work in accordance with the contract and applicable law.
Where the Construction Contracts Act 2002 applies, any suspension of construction work will be carried out in accordance with the requirements of that Act.
Suspension or postponement may affect the originally scheduled commencement or completion date.
Where the work constitutes construction work under the Construction Contracts Act 2002 (NZ) ("the Act"), the Act applies to the contract to the extent required by law.
Nothing in these Terms of Trade is intended to contract out of, exclude or limit any provision of the Act that cannot lawfully be excluded or limited.
Where applicable, the parties have the rights and obligations provided by the Act in relation to payment claims, payment schedules, progress payments, non-payment, suspension and adjudication.
A payment claim made under the Act must comply with the requirements of the Act, including any prescribed information that must accompany the payment claim.
A normal Xero invoice or request for payment should not be treated as a statutory payment claim under the Act unless it has been prepared and served as a payment claim in accordance with the Act.
Where applicable, Concrete Grind Pro may use the payment claim, suspension, adjudication and enforcement procedures available under the Act.
The Act provides a statutory adjudication process for resolving disputes relating to construction contracts, including payment disputes.
Nothing in these Terms limits any right or remedy available under the Act.
Payment is due by the date stated on the invoice or, where applicable, in accordance with the payment requirements of the Construction Contracts Act 2002.
If payment becomes overdue, Concrete Grind Pro may issue payment reminders and request immediate payment.
Where an amount remains overdue, Concrete Grind Pro may take reasonable steps to recover the outstanding amount.
To the extent permitted by law, reasonable costs incurred in recovering overdue amounts, including reasonable debt collection, legal and enforcement costs, may be charged to the customer.
Nothing in these Terms limits any statutory rights or remedies available to either party.
Concrete is a natural and variable substrate and finished appearance may vary across a floor.
The final result can be affected by the original concrete mix, aggregate, placement, finishing, curing, age, repairs, contamination, grinding depth and other existing conditions.
Samples or test areas, where provided, demonstrate the proposed process and finish. Natural variation between a sample area and the completed floor may occur.
Concrete Grind Pro will carry out the agreed process with reasonable care and skill. A particular visual result will only be guaranteed where it has been specifically agreed in writing and is reasonably achievable from the existing slab.
Concrete Grind Pro stands behind its workmanship in accordance with the applicable warranty issued for the project.
Warranty coverage is subject to the applicable warranty terms, recommended maintenance and the condition and movement of the underlying concrete slab.
Warranty does not automatically cover structural movement, movement cracks, damage caused by other contractors, misuse, neglect, impact, chemical damage, abnormal wear or matters outside Concrete Grind Pro's reasonable control.
Where third-party products are used, any applicable manufacturer's warranty will apply according to the manufacturer's terms.
The customer is responsible for removing or protecting personal property, furniture, equipment and other items from the work area unless removal or protection has been specifically included in the quotation.
Concrete Grind Pro will take reasonable care when carrying out the work.
The customer must identify any sensitive areas, finishes, equipment or property requiring special protection before work commences.
If the customer believes there is a problem with the work, they should notify Concrete Grind Pro as soon as reasonably practicable and provide reasonable details of the concern.
Concrete Grind Pro will have a reasonable opportunity to inspect the work and, where appropriate, remedy a workmanship issue.
Nothing in these Terms excludes, restricts or modifies any right that cannot lawfully be excluded, restricted or modified under New Zealand law.
These Terms apply to both residential and commercial work, subject to the rights and obligations that apply under New Zealand law.
Where the parties are legally entitled to contract out of applicable consumer legislation, any such agreement must be made in writing and will only apply to the extent permitted by law.
Nothing in these Terms is intended to exclude any statutory right that cannot lawfully be excluded.
Any change to the agreed scope, price or payment arrangement should be confirmed in writing.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
These Terms are governed by the laws of New Zealand.
These Terms should be read together with the accepted quotation, agreed variations and any applicable warranty documentation.
